Mytras Terms & Conditions

These Terms & Conditions apply to all offers, orders and agreements between Mytras and consumers who purchase a mattress via mytras.nl for delivery in the Netherlands.

1. Definitions

In these Terms & Conditions:

  • Mytras, “we”, “us”, “our”: the operator of the Mytras webshop supplying mattresses to consumers.

  • Consumer, “you”, “your”: a natural person not acting in the course of a trade or profession, who enters into a contract with Mytras via the webshop.

  • Product: a Mytras mattress purchased via our webshop (we currently sell mattresses only).

  • Distance contract: a contract concluded between you and Mytras exclusively by means of one or more distance communication techniques (such as our website).

  • Right of withdrawal: the statutory EU right to cancel an online purchase within 14 days without giving any reason.

3. Scope of these Terms & Conditions

  1. These Terms & Conditions apply to every offer from Mytras and every distance contract concluded via our webshop with a consumer.

  2. Before the contract is concluded, these Terms & Conditions are made available to you in a way that allows you to store and reproduce them (for example by downloading or printing).

  3. If any part of these Terms & Conditions is found invalid or unenforceable, the remaining provisions will remain in full force.

4. Our offer

  1. We present our mattresses, prices and main characteristics on mytras.nl as clearly and completely as reasonably possible, including dimensions, materials, firmness indication and warranty.

  2. All offers are non-binding and valid only as long as they are shown on the website and while stocks last.

  3. Obvious mistakes or errors (for example a clearly incorrect price) do not bind Mytras.

5. Formation of the contract

  1. A contract is concluded once you complete the checkout process, accept these Terms & Conditions and submit your order by clicking the final confirmation button (e.g. “Order” or “Pay now”).

  2. You will then receive an order confirmation by email including an overview of your order and these Terms & Conditions.

  3. Mytras may reject an order or ask for additional information, for example in case of suspected fraud, incorrect data or payment issues. If we cannot accept your order, we will inform you and refund any payments made.

6. Prices and payment

  1. All prices on the website are in euros (€) and include Dutch VAT, unless clearly stated otherwise.

  2. Any delivery fees or additional costs are shown clearly before you complete your order.

  3. The price applicable to your order is the price shown at the time you place the order.

  4. Payment must be made using one of the payment methods offered on the website (for example iDEAL, card or other listed options).

  5. In case of non-payment or suspected fraudulent behaviour, we may cancel the order after informing you.

7. Delivery

  1. We deliver mattresses to addresses in the Netherlands (and any other countries explicitly indicated on our website from time to time).

  2. Indicative delivery times are shown on the product page or during checkout. We aim to deliver within the indicated time, but these are estimates.

  3. If delivery is delayed or a mattress cannot be delivered, we will inform you as soon as possible and you may cancel the order free of charge.

  4. Delivery takes place at the address you provide during checkout. You are responsible for ensuring that your details are accurate and complete.

  5. The risk of damage or loss passes to you once the mattress has been physically delivered to you or a third party designated by you.

8. Statutory 14-day right of withdrawal

  1. As a consumer buying online, you have a legal right to withdraw from the contract within 14 days after the day on which you receive the mattress, without giving any reason.

  2. To exercise this right, you must clearly inform us of your decision to withdraw within this 14-day period (for example by email).

  3. After notifying us, you have another 14 days to return the mattress or to hand it over to the carrier designated by us.

  4. During the withdrawal period you may handle and inspect the mattress only to the extent necessary to determine its nature, characteristics and functioning – comparable to what you would be allowed to do in a physical shop.

  5. You are liable for any diminished value of the mattress resulting from use that goes beyond this, such as heavy soiling or damage.

9. Returns and refund process

  1. To initiate a return, please contact us at info@mytras.nl with:

    • Your name

    • Order number

    • Mattress model and size

    • Whether it concerns a defect or a trial return

  2. We will confirm your request and provide instructions for collection or return. In many cases we will arrange pick-up through a contracted carrier.

  3. Unless otherwise stated on the product page or during checkout:

    • We may offer free returns, or

    • Charge a reasonable contribution to return costs; if so, this will be clearly communicated in advance.

  4. Once we have received and inspected the mattress, we will process the refund as soon as possible and no later than 14 days after you informed us of your decision to withdraw, provided we have received the mattress or you have supplied proof of return.

  5. Refunds are made using the same payment method you used for the original transaction, unless you explicitly agree otherwise.

10. Warranty and conformity

  1. Our mattresses come with a 10-year limited warranty against manufacturing and material defects, as described in the Mytras Mattress Warranty page.

  2. This contractual warranty is in addition to, and does not limit, your statutory rights under Dutch and EU consumer law (for example your right to a product that conforms with the contract and is of satisfactory quality).

11. Liability

  1. To the fullest extent permitted by law, our liability is limited to the purchase price of the mattress concerned, unless damage is caused by intent or gross negligence.

  2. We are not liable for indirect or consequential damage such as loss of income, loss of profit or non-material damage, unless mandatory law does not allow such limitation.

12. Complaints and dispute resolution

  1. If you have a complaint about your mattress or our service, please contact us as soon as possible using the details in Article 2.

  2. Describe your complaint clearly so we can investigate and respond.

  3. We aim to respond within a reasonable period, typically within 5 working days.

  4. If we cannot resolve the complaint together, you may submit the dispute to the competent Dutch court as described in Article 14, and you may also use the European ODR platform for online dispute resolution in cross-border disputes.

13. Applicable law and competent court

  1. These Terms & Conditions, and all contracts between you and Mytras, are governed by Dutch law, without prejudice to mandatory consumer protection rules that apply in your country of residence within the EU.

  2. Any dispute that cannot be resolved amicably will be submitted to the competent court in the Netherlands, unless mandatory law designates another competent court.
